Replaio Search Console Service
Replaio Search Console is a free tool that enables comprehensive management of the visibility of websites, radio stations, and podcasts in the Replaio search engine – Replaio Search.
Information About the Application's Functionality Regarding Radio Stations
Replaio is not a broadcaster, nor is it a hosting service; it does not re-broadcast, store, or retransmit radio stations.
Replaio is a web browser that plays publicly available audio content by redirecting the user to the broadcasters' servers and then establishing a direct connection with those servers. The user's device connects directly to the public URLs of those servers to play the audio content. These servers are fully managed and controlled solely by the radio station broadcasters.
Users can listen to these radio stations to which they have access in any web browser, using the same public URLs.
Replaio operates in the same way as other devices and applications for playing internet radio, including smart speakers, internet radio receivers, or in-car internet radio systems. Just like traditional FM/AM radio, which connects directly to broadcasters' transmitters, Replaio connects directly to broadcasters' servers to play audio content.
I. Introduction
Thank you for using our services, which we provide with the goal of offering convenient access to websites, radio stations, and podcasts.
By providing our services, we respect the decisions of content owners to share URLs and we respect intellectual property rights.
These Terms of Service constitute an agreement for the provision of electronic services by the Provider. The agreement is concluded when the User accepts the terms of this Agreement for the Replaio Search Console service.
The terms apply to users representing content owners – websites, radio stations, and podcasts, using the Replaio Search Console Service.
II. Provider of the Replaio Search Console Service

Replaio operates based on the legal regulations applicable in Poland. Use of the services in other locations may be subject to different, local regulations.

Replaio is the brand of Replaio sp. z o.o. All other names, trade names, brands, and trademarks that may appear in the Replaio Search Console Service are owned by their respective owners and are used for informational and identification purposes. Replaio and the services we provide are in no way affiliated with these entities.
III. Users of the Replaio Search Console Service

Replaio Search Console can be used by content owners (websites, radio stations, and podcasts) — companies and organizations, including users representing content owners.

A user, when using our services on behalf of a company or organization, may do so if they have previously obtained authorization to represent that entity.
IV. Types and Scope of Services Provided Electronically by Replaio, Referred to as Replaio Services
Definitions related to the services
Replaio Search Console — is a service available through a web browser that allows monitoring and optimizing the presence of websites, radio stations, and podcasts in the results of Replaio Search.
Replaio Search — is a service that provides a search engine for publicly available URLs of websites, radio stations, and podcasts.
Public URL — a hyperlink, i.e., a reference to a publicly available website or a hyperlink leading to publicly available websites and audio content (e.g., internet radio stations, podcasts) on the internet. The URL always remains under the full and exclusive control of its owner.
Replaio App — a mobile app providing Replaio services available through the Google Play store — available Here.
Replaio Browser — a web browser service available within the Replaio app with a built-in audio content player, e.g., for radio stations or podcasts.
Replaio Search and Replaio Search Console Services
Replaio Search Console — is a free tool that allows monitoring and optimizing the presence of websites, radio stations, and podcasts in the results of Replaio Search. It is intended for content owners, including broadcasters and radio stations. In particular, it allows managing the availability of their own URLs in the Replaio Search service, including the Replaio app.
Replaio Search — is a service that provides a search engine for publicly available URLs of websites, radio stations, and podcasts. It enables users to search for URLs by submitting queries using keywords.
1. Search Results in Replaio Search are Generated in Three Stages
1.1. Crawling — gathering information about publicly available URLs on the internet.
1.2. Indexing — analyzing URLs obtained from content owners, including through Replaio Search Console and as a result of Replaio’s crawling bots, for the public availability of websites, radio stations, and podcasts.
1.3. Displaying Results — searching for information in Replaio Search and appropriately presenting the results to users.
2. Public URLs
2.1. All URLs available in Replaio Search are publicly available on the internet.
2.2. Replaio is not a broadcaster, does not transmit, and does not mediate in the transmission of audio. It does not retransmit or interfere with the audio stream available under specific public URLs.
2.3. Replaio Browser connects the user's device directly to the server used by the URL owner solely for displaying or playing content from the source location on the internet located under the specified public URL.
2.4. Replaio does not alter the content available under specific URLs in any way.
2.5. Replaio does not violate any access restrictions if such are applied by the URL owners.
2.6. To ensure free access to public content, Replaio Search removes URLs only under strictly defined circumstances, e.g., at the request of their owners.
2.7. The intellectual property rights to the content available under the URLs are the responsibility of the respective URL owners. Replaio is not responsible for the legality of the content available under public URLs.
2.8. Replaio users are always recipients of the content as originally made available. All URLs indexed by Replaio Search are publicly available on the internet. Website owners where these URLs are published do not restrict access to them — they are available to all internet users. The solutions used by Replaio (including embedding) do not provide the URLs to a new audience (new users).
2.9. Replaio does not index URLs that have security measures preventing content from being played directly from a specific URL (e.g., a temporary access key).
3. Adding URLs to Replaio Search
3.1. URLs leading to content available in Replaio services are added to Replaio Search by the owners via the Replaio Search Console tool or Replaio's crawling (indexing) bots.
3.2. Any content owner, including a radio station, website owner, or podcast, can submit their URLs to Replaio Search.
3.3. The presence of URLs in Replaio Search is free of charge.
3.4. Submissions can be made via: Replaio Search Console.
3.5. The person who adds and approves the data via Replaio Search Console is responsible for the data submitted.
3.6. By submitting data to Replaio Search, the person acting on behalf of the broadcaster declares that all data, including contact information, is true.
3.7. Submitting data to Replaio Search via Replaio Search Console is considered as consent by the owner for the processing and sharing of this data within Replaio Services.
3.8. In particular, the user grants Replaio the right to share URLs leading to content and graphic representations of the broadcaster’s brand.
3.9. The user declares that they have full rights to the submitted content and is fully responsible for it.
3.10. The user declares that by submitting URLs leading to content, they are not violating applicable law, especially copyright law.
3.11. The user declares that the responsibilities imposed by copyright law in relation to the publication or broadcast of content lie with the owner they represent, and that the owner is fully responsible for them.
3.12. Furthermore, the user, on behalf of the owner, declares that:
- They are the owner or have the right to publish/broadcast the content to which the submitted URLs lead,
- They have all necessary rights, licenses, authorizations, and third-party permissions required to share content via URLs,
- They are fully responsible for complying with the terms of the licenses, authorizations, and permissions entered into with third parties regarding the content available under the URLs,
- They are fully responsible for any financial settlements related to royalties and fees to third parties resulting from the licenses, authorizations, or permissions related to copyright.
3.13. The user, on behalf of the owner, declares that they are fully responsible for the distribution and for any need to limit the distribution of their URLs within specified territories. This means that the owner, when sharing their content in specified territories, has obtained all necessary rights, and if they lack such rights, they must implement measures to block distribution in locations where their content should not or cannot be accessible.
3.14. The user, on behalf of the owner, declares that they are fully legally responsible for the publication, in any form, of advertisements within the content available under the URLs.
3.15. The user declares that they comply with legal regulations regarding the publication of information and advertisements, including FTC (Federal Trade Commission) guidelines.
3.16. By publishing content, including URLs, names, descriptions, and graphic elements, the user grants Replaio a non-exclusive, free, worldwide license to reproduce, distribute, display, modify, translate, create derivative works, and distribute through any medium, method, or technology currently known or that may be developed in the future, for any purpose, including promoting Replaio services.
3.17. If the user does not want Replaio to use the content of the owner they represent, they should not publish it through Replaio Search Console.
3.18. By publishing data and using Replaio Search Console, the user releases Replaio from any responsibility for possible damages and expenses (including attorney fees) related to the owner they represent violating any law, including third-party rights.
3.19. It is prohibited to add URLs leading to prohibited content via Replaio Search Console, which:
- Contain or promote sexual content and obscenities, including pornography, and any content and services aimed at sexual gratification,
- May be interpreted as promoting or encouraging sexual acts in exchange for compensation,
- Are associated with aggressive sexual behavior,
- Incite violence or hatred toward individuals or groups based on their race, religion, disability, age, nationality, sexual orientation, gender, or any other aspect related to discrimination,
- Promote unjustified violence or other dangerous activities,
- Glorify acts of terrorism, incite violence or terrorist attacks,
- Glorify violence against civilians,
- Disrespect important social, cultural, or political events, such as natural disasters, conflicts, death, or other tragic situations,
- Contain threats or aim to harass, bully, extort, or blackmail,
- Encourage self-harm or harm to others,
- Promote the sale of illegal products: explosives, firearms, ammunition, firearm accessories, marijuana and marijuana-based products,
- Promote the sale of tobacco or encourage illegal or improper use of alcohol or tobacco,
- Contain false statements that may negatively impact participation in democratic life (including elections) or social trust,
- Mislead with falsified information related to politics, social issues, or matters important to public opinion,
- Promote the sale of products obtained from endangered animal species.
3.20. The user, on behalf of the owner, declares and guarantees that the content linked to by the URLs provided in Replaio Search Console does not contain prohibited content as listed above.
3.21. The user, on behalf of the owner, acknowledges and accepts that Replaio has the right to display advertisements within the app — graphic banners and video ads. At the same time, Replaio ensures that none of these forms of advertising will disrupt the continuity of the audio content linked by the URLs provided by the broadcasters.
4. Adding URLs to Replaio Search via Crawling (Indexing) Bots
4.1. To make URLs leading to publicly available content on the internet available in Replaio Search, we also use crawling bots.
4.2. The bots work by visiting publicly available websites. They scan them similarly to search engines and analyze their content for publicly available URLs.
4.3. The indexing bots open links just like users browsing websites. They move from link to link and send information about publicly available URLs to Replaio Search.
4.4. The indexing bots also analyze the content of the "robots.txt" files, which are used to determine how content on the visited website should be treated.
4.5. The website owner, through appropriate entries in the "robots.txt" file, can completely block the indexing of their pages by the bot, thereby disabling the sharing of links to content, including audio content, in Replaio Services.
5. We Respect and Honor the Decisions of URL Owners Regarding URL Availability
5.1. Replaio respects and honors intellectual property rights and does not tolerate violations. We have developed tools to manage the availability of URLs in Replaio Search, including a policy that covers the procedure for reporting violations. We respect the decisions of owners of specific URLs regarding their presence in Replaio Search.
5.2. We have developed a free, secure tool, Replaio Search Console, which enables the monitoring and optimization of the presence of websites, radio stations, and podcasts in Replaio Search results.
5.3. Replaio Search Console allows URL owners to fully control the presence of their URLs in Replaio Search, including (at any time) withdrawing consent for their presence in Replaio Search, blocking the ability to add or modify them by unauthorized users.
5.4. Using Replaio Search Console and the ability to manage URLs belonging to stations ensures access only for authorized users.
5.5. Managing URLs is possible after completing the verification procedure. This ensures access only for authorized users. The procedure involves verifying the right to access the domain that may be used by the broadcaster, including the radio station.
To perform the verification procedure, the following steps must be taken:
(1) In Replaio Search Console, locate the "Verification" section, click the "Add Domain" button, and enter the website address of your radio station.
(2) Verify and ensure that the robots.txt file on your site does not block Replaio's bot. The following entries are checked:

(3) After adding the website address and verifying the robots.txt file, generate a verification file using the "Generate Verification File" button. An HTML verification file will be generated and downloaded, containing a unique token necessary for proper domain verification.
(4) Place the file on your server in the root directory of your website. The file should be available at:
http://yourdomain.com/replaio-verification.html
(5) Return to the Replaio panel and click the "Verify" button. The system will check if the file has been correctly placed and contains the appropriate token.
After successful verification, you can manage your profile in Replaio Search Console and manage URLs and information available in Replaio Search.
5.6. Replaio Search is a search engine for publicly available, unsecured URLs. Each URL owner can secure their URLs to prevent them from being added to search engines, including Replaio Search. This can be done using widely available solutions, including entries in robots.txt and .htaccess files, or others (e.g., setting an expiration time for a specific URL).
5.7. These are commonly accepted, cost-free, and easy-to-implement mechanisms, interpreted by all indexing services on the internet. Information about such security measures is widely available. More information can also be found later in this document.
5.8. Each URL owner has the option to apply security (e.g., by using a so-called temporary access key) to prevent their URLs from being played in external browsers. Such security measures are commonly used by entities that do not allow public sharing of URLs.
5.9. The use of such a security measure is a clear indication that such URLs will not be indexed by Replaio Search and will not be available in Replaio Search results for Replaio Radio users.
6. Blocking URLs Using Widely Available Tools and Technologies
6.1. The Replaio Browser simply establishes a direct connection between the user's device and the source available under the URL, therefore, the transmission can only be fully controlled and managed by the content owner.
6.2. Each content owner can independently block access to their content by changing the status of the publicly available URL to authenticated. Such secured content will immediately stop being available in Replaio services. No additional actions by Replaio are required.
6.3. (Alternative Option) Removal of URLs from Replaio Search can also be done upon explicit request by contacting us via email at: support@repla.io. URLs submitted by their owners will be added to the blocked list. From that point onward, they will not be available in Replaio Search results, cannot be added again through Replaio Search Console, and will not be indexed by Replaio bots.
6.4. (Alternative Option) Each content owner can block access to their content by making appropriate configuration entries on their servers — standard mechanisms to block bots by configuring the robots.txt file:

Such entries will be explicitly interpreted as a lack of consent for indexing and sharing URLs in Replaio Radio.
6.5. Audio streaming service providers for radio stations offer various options to control access to streams. Some of them include:

Securing the stream with referer headers – The stream can be configured to work only when played from a website or service that sends the appropriate HTTP header. This header indicates that the playback is from an authorized source. If someone tries to play the stream directly in another player, access is blocked because the appropriate referer header will be missing.

Session tokens – These are unique identifiers for each playback session that expire after a certain period. This allows restricting stream playback to authorized websites or services, preventing unauthorized access.

Geofencing – This method uses the user's geographical location to control access to the stream. Service providers typically use the user's IP address to determine their location and block access to the stream outside of a defined geographical area.

Host-based restriction – In this case, access control is based on the user's IP address that attempts to connect to the streaming server. Only users from authorized IP addresses can play the stream.

User Agent-based restriction – This method analyzes information sent by the user's browser or device when establishing a connection. The User Agent is a string that identifies the browser, operating system, device type (e.g., computer, phone), and sometimes even software version. Based on this, access to the stream can be restricted to specific devices or browsers.
7. Graphic Identification in Replaio Services
7.1. For graphic identification purposes, search results in Replaio Search, using public URLs, display publicly available identification marks (logos) of content owners.
7.2. Displaying graphic marks linked to publicly available URLs is done similarly to how it's done in widely available search engines.
7.3. URLs leading to identification marks are URLs of graphic files such as: website logos (e.g., ico, og:image), avatars, or profile pictures shared on public profiles of popular social media platforms (e.g., Facebook, Twitter, Instagram).
7.4. Any audio content owner can submit their identification marks to be included in Replaio Search via Replaio Search Console or by sending an email to: support@repla.io.
7.5. Indexing and displaying identification marks are done using standard caching mechanisms — similar to popular web browsers.
7.6. The Replaio Browser does not provide an option for users to download or share identification marks.
7.7. Graphic images displayed in Replaio Search results may be subject to copyright.
7.8. Users of Replaio Radio utilizing search results that contain identification marks must ensure that they do not violate any legal provisions.
7.9. Replaio does not grant users any rights to the graphic identification marks of third parties.
VI. Copyright of Audio Content

Replaio does not have the technical or legal means to verify or determine the ownership of the copyright for content available under publicly accessible URLs on the internet.

It is prohibited to use our services to infringe upon copyright. We do not allow URLs leading to content that violates copyright to be added through Replaio Search Console, even if the URLs are publicly available on the internet.

Replaio displays and plays only content that is publicly available on the internet. Content owners, i.e., the owners of the URLs, are fully responsible for the content and any copyright, industrial property, and personal rights violations resulting from that content.

The responsibility for fulfilling obligations imposed by copyright law (e.g., geo-blocking) lies with the URL owners.
VII. Reporting Violations, Including Illegal Content Defined under the Digital Services Act (DSA)

Replaio respects the law, including laws related to the publication of information and intellectual property rights. Replaio does not tolerate any form of law violation.

A Replaio user has the ability to report any instance of a legal violation, including the presentation of prohibited content as described under the Digital Services Act (DSA) and intellectual property law, by contacting us via email at support@repla.io.

Additional forms of reporting violations include completing and submitting the following forms:

Each report of a violation may have legal consequences. We ask that you thoroughly analyze the case of the violation before submitting the report.

If Replaio is notified that any Content available through a URL violates the law, including copyright law, Replaio may remove these URLs from Replaio Services or take other actions it deems appropriate, without prior notice.

In the case of multiple violations by users who add URLs to content that violates applicable law and the terms of this Agreement, Replaio may remove the account and block access to the services.

If there is reason to suspect that content added via Replaio Search Console violates the Terms of Service of Replaio, violates applicable law, or could harm other Replaio users or third parties, we reserve the right to remove part or all of such content.
VIII. Terms of Service Provided by Replaio

The use of our services is subject to these Terms of Service. Please carefully read these terms, our Privacy Policy and Cookie Policy for Replaio Services, and any other terms specified in this document. If you do not understand the Agreement or do not accept any part of it, you cannot use Replaio Services.

Before starting to use Replaio services, the user confirms that they have read these Terms of Service for Replaio Radio and the Privacy Policy and Cookie Policy for Replaio Services.

The content of this Agreement applies to all users, including users representing content owners using Replaio Search Console.

Replaio Radio allows access to content available under public URLs only for private, non-commercial purposes.

Replaio prohibits users from providing content that violates applicable laws, content that violates personal rights or other third-party rights, confidential content, offensive, vulgar, or discriminatory content, content inciting crime, or content that is inconsistent with good morals.

Using Replaio Services may incur charges for internet access and data transmission fees imposed by third-party companies — internet or mobile operators. Payment of these fees is the responsibility of the user.

Access to and use of the Services provided by Replaio in the form made available is possible provided that the terms of these conditions and applicable laws are followed.

To create an account, the user must use the "Log in" feature.

By providing your data, including your email address, you consent to the collection and use of this data in accordance with the Privacy Policy available at: https://legal.repla.io/privacy.

If you need to change your password, use the "Change password" option in the "Your Account" section. The procedure for recovering a lost password is available from the login window.
IX. Technical Requirements for Replaio Search Console Services

To use Replaio Search Console, you must have a device with an updated, modern web browser and internet access.

The quality of the Services may depend on the internet connection parameters, its quality, and the configuration of the end-user devices.
X. Prohibited Actions While Using Replaio Search Console

The use of Replaio's IT systems to commit an illegal act.

Improper use of procedures established for reporting claims, including sending baseless and false information.

Using Replaio Services to distribute prohibited content, including audio content.
XIV. Limitation of Liability
To the extent permitted by applicable law, Replaio shall not be liable for:

Any losses or damages resulting from a breach of the Agreement by Replaio, which could not have been foreseen at the time of the Agreement's conclusion.

Losses and damages incurred by the user as a result of changes that may be introduced to Replaio Services, temporary or permanent cessation of services, or the removal of elements and functions within Replaio Services.

Issues in accessing Replaio Services arising from, including but not limited to, lack of internet access, other issues, network errors, or problems, errors on the network provider’s infrastructure, telecommunication, electronic, or computer issues, and limitations in using Replaio Services due to infrastructure overload or similar errors and problems.

If the User is using the service to conduct business activities, to the extent permitted by law, Replaio shall not be liable for lost profits, revenues, or data, loss of business opportunities, or expected savings, or indirect or consequential losses.
XV. Privacy, User Data

Replaio commits that during the processing of personal data in relation to the provision of Replaio Search Console services and after their completion, it will comply with the applicable and relevant regulations regarding personal data protection, including in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and Council, dated April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, GDPR).

In our Privacy Policy and Cookie Policy for Replaio Services, we explain in detail how we process data and how we protect the privacy of users while using Replaio Services.

Please note that while using Replaio Search Console, cookies may be stored on the user's device. Additionally, other technologies necessary for proper service delivery may be used.

Replaio commits to exercising due diligence in securing data sets, in accordance with technical or economic considerations.
XVI. Changes to Replaio Search Console

Replaio may, at its discretion and at any time, modify, add, or remove content and features available within Replaio Search Console without notice.

Replaio may discontinue or cease support for any version of Replaio Search Console.

Replaio also reserves the right to stop providing some or all of the functions within Replaio Services at any time and at its discretion, including providing software updates and support for different devices or platforms.

As a user of Replaio Services, you acknowledge and accept that Replaio will not be liable to users or third parties for any modifications, suspension, or discontinuation of Replaio Services.
XVII. Changes to the Terms of Service

We may modify these Terms to reflect changes in our Services, legal, regulatory, or security changes.

Replaio will notify users of changes to the Terms of Service in advance.

Changes related to new features provided in Replaio Services or introduced for legal reasons take effect immediately.

When making significant changes to these Terms, Replaio will notify users, for example, by displaying a prominent notice within Replaio Services or by sending an email.

All changes to the Terms become effective upon publication.

After the information about changes in the Terms has been released, the User is required to promptly familiarize themselves with the changes.

If you do not accept the modified Terms, you should stop using Replaio Services.

If you continue to use Replaio Services after being notified of the changes, we will consider this as acceptance of the new Terms by you.
XVIII. Other Provisions
If any provision of these Terms is found to be invalid, the invalid provision will be replaced with a provision that most closely aligns with the intended legal purpose of the invalid provision.
The courts in Poland have exclusive jurisdiction to resolve any disputes that may arise from these Terms of Use or in connection with them.
These Terms of Use are subject to and will be interpreted in accordance with Polish law, excluding conflict of law provisions.
If you do not comply with the provisions of these Terms and Replaio does not take immediate action, this does not mean we waive any of our rights, such as the right to take action in the future.
