By providing Replaio Services, we strive to ensure that using them is enjoyable and safe for you. When you use our services, you entrust us with data related to using Replaio services. We assure you that the data, including personal data, is processed to a minimal extent and only what is necessary to deliver our services at the highest level.

We respect and protect the privacy of our users. This is a key principle that guides us at Replaio. In this document, we want to present to you the principles we apply when processing personal data. We encourage you to thoroughly read our policies and practices.

We process personal data following the law, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons about the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (GDPR).

The administrator of personal data processed as part of Replaio Services is Replaio sp. z o.o. based in Krosno, ul. Tysiąclecia 14a, NIP 6842650730, REGON number 381340090, entered into the National Court Register by the District Court in Rzeszów, 12th Commercial Division of the National Court Register, under KRS number 0000749616.

The Privacy Policy applied within Replaio Services is inseparably linked with the Terms of Use, which defines the terms of use of Replaio Services.

In our Privacy Policy, we aim to provide you with information about the processing of personal data within the framework of Replaio Services. We will explain:

  • What data do we process?
  • For what purpose and on what basis do we process data?
  • What rights do you have?
  • How long do we store data?
  • Do we share data, and where can it be processed?
  • Who do we obtain personal data from?
  • How do we protect the personal data we process?
  • What is our policy regarding children's privacy?

3. What Personal Data Do We Process?

We process only the necessary data that you provide or leave while using Replaio Services, as well as data from our partners. These are primarily data necessary to provide Replaio Services, including providing you with access to a Replaio account. You can use Replaio Services anonymously — without creating a Replaio account. However, this does not preclude us from processing personal data.

Providing certain personal data is voluntary, but not providing it in the case of some services will prevent their provision.

More information on what data we process can be found in the next section, “Purposes of Data Processing.”

4. For What Purpose and On What Basis Do We Process Personal Data?

The primary purposes for processing your data are:

  • providing Replaio Services available through the Replaio application, websites repla.io, blog.repla.io or Replaio Search Console
  • fulfilling our legal or contractual obligations,
  • realizing our legitimate interests.

When you start using our services, e.g., by installing the Replaio Radio app or visiting our websites or online services, you accept and enter into an agreement with us in accordance with our Terms of Use. According to this agreement, we are obligated to provide you with services, which requires processing personal data.

4.1. Purposes of Data Processing

4.1.1. Provision and Personalization of Replaio Services

To provide services to users who do not use the login option (without a Replaio Account), we process data concerning the user's device, the device's IP address, the information contained in cookies or other similar technologies, and session data.

To offer Replaio Services tailored to the user's location (e.g., suggesting local radio stations), it is necessary to process location data. To provide Replaio services, the user's device IP address is processed. This simplified “geolocation” i.e., assigning the service provision location, is based solely on the IP address. The information obtained in this way does not allow for precise information about the user's actual location.

When providing services to users with an account in Replaio services, we additionally process the following:

  • Information necessary for account registration: email address and password,
  • Information provided for account identification: username (nickname), first name, last name,
  • Information necessary for logging in via other services: Facebook, Google, Huawei: email address, first name, last name, avatar,
  • In the case of additional paid options available in Replaio Services – payment information.

Using an account in Replaio services requires providing authentication data: email address and password. For the Replaio app, providing first and last name is optional, and the user can add it at any time as identifying information for the account. We process this data to provide services, i.e., to fulfil the contract. The legal basis for collecting and processing personal data is Article 6(1)(b) of the GDPR.

4.1.2. Contact implementation

When contacting our users regarding technical support and use of the application and collecting opinions about the application, we process the e-mail address and the content of the message.

We process this data to provide services, i.e., perform the contract and for the legitimate interest of ensuring contact with users. The legal basis for the collection and processing of personal data is Art. 6 section 1 letter b and art. 6 section 1 letter f GDPR.

4.1.2. Newsletter

For users who voluntarily subscribe to the Newsletter service, we provide a service of delivering messages with information related to Replaio Services. For this purpose, we process the email address provided by the user during registration.

The email addresses provided, for this purpose, are processed to fulfil the contract following Article 6(1)(b) of the GDPR.

As part of the Newsletter service, we may send users marketing content promoting Replaio services and products, as well as those of our partners. Personal data in this case is processed based on legitimate interest under Article 6(1)(f) of the GDPR.

The email address used within the Newsletter service may also be processed to potentially establish, investigate, or defend against claims. The legal basis for processing is our legitimate interest according to Article 6(1)(f) of the GDPR, which involves protecting our rights.

4.1.3. Diagnostics, troubleshooting, development, development of new features, and improvements to Replaio Services

To improve the quality of our services, we may process information regarding the use of Replaio Services, including session information, IP address, time spent using Replaio Services on individual screens, pages, and subpages, and the use of features and content.

We process this data to provide services, i.e., to fulfil the contract, and in our legitimate interest, which involves creating solutions to facilitate service usage and improving the quality and functionality of the services provided. The legal basis for collecting and processing personal data is Article 6(1)(b) and Article 6(1)(f) of the GDPR.

4.1.4. Statistics

For statistical analysis of service usage, Replaio uses services provided by Google Ireland Limited: Google Analytics and Google Firebase, a service provided by:

Google collects and processes data that enables the analysis of how users use Replaio Services. Data obtained in this way is not in any way linked to other personal data processed by Google. Replaio does not influence the extent of such data collection. The legal basis for processing data is Article 6(1)(f) of the GDPR.

4.1.5. Marketing, Promotion, and Advertising

Direct Marketing

We do not use personal data, including email addresses and other identity-related data of users, for marketing purposes of other entities. However, we may occasionally send information about our promotional activities in the form of email messages or push notifications directly within the application.

To partially cover the costs of maintenance, we place advertisements in our services delivered by our partners. To deliver ads and content more tailored to user interests, our partners may use advertising identifiers or similar technologies.

Interest-Based Personalized Advertising

Profiling for marketing purposes is carried out by our trusted partners, subject to your consent. Consent is voluntary and can be given through a message displayed during the consent collection process. You can withdraw consent at any time.

The delivery of ads tailored to user interests is done using unique identifiers. We do not combine this information with user identity information.

Our partners whose services we use include:

a) Google

Replaio utilizes Google's services to display ads in Replaio Services (text ads, banners, etc.). Cookies may be stored on the user's device, or other solutions used by Google, or third-party websites acting on behalf of Google, such as ad identifiers. Google collects data on user interests based on the websites they visit or apps they use. Google uses this information to analyze user behavior regarding advertisements. If necessary, Google may also disclose this data to third parties if the third party processes data on Google's behalf. Google does not link the user's IP address with other data. Replaio has no control over the processing of personal data by Google.

You can block the installation of cookies or the use of similar technologies through settings on your mobile device. You can also limit the collection of data related to app usage by Google by changing ad display settings. More information can be found at: https://policies.google.com/technologies/ads.

Ads delivered by Google are displayed based on user activity and the way they use Google services. Analyzed data includes information added to the Google account, interests estimated based on online activity, and interactions with advertisers cooperating with Google for ad display. b) Facebook

Replaio uses services provided by Facebook to display ads in Replaio (text ads, banners, etc.). For this purpose, Replaio sends pseudonymized data to Facebook along with information that the application has been launched. An advertising identifier provided by the device's operating system is used. Replaio has no control over the data processing process by Facebook Inc. Ads delivered by Facebook are displayed based on your activity and use of Facebook services. Analyzed data includes pages liked by you and your friends, information from your Facebook and Instagram profiles, and places where you check in on Facebook. You can find settings related to your preferences for ads delivered by Facebook at: https://www.facebook.com/adpreferences/ad_settings.

We process this data in our legitimate interest, which involves obtaining the funds necessary to finance the services provided. The legal basis for collecting and processing your data is Article 6(1)(f) of the GDPR.

4.1.6. Investigative Procedures, Claims Investigation

In cases related to breaches of the Terms of Use or legal regulations, procedures for asserting our claims, and defending against claims from users or other entities, we may process personal data of specific users.

If personal data is processed to assert the claims of other users, this data may be disclosed to other users and entities, or to public authorities authorized by law, such as courts, police, or prosecutors.

We will process and, if necessary, disclose this data to fulfil our legal obligations, i.e., in our legitimate interest of asserting our claims against the user. The legal basis for collecting and processing your data is Article 6(1)(c) of the GDPR.

4.1.7. Ensuring Legal Compliance

We may process personal data to fulfill legal obligations related to our activities and requests from law enforcement authorities. The legal basis for such processing of personal data is compliance with applicable legal regulations and our legitimate interest. The legal basis for collecting and processing your data is Article 6(1)(c) and Article 6(1)(f) of the GDPR.

4.1.8. Social Media

Facebook

As part of managing profiles on social media platforms such as Facebook, we may have access to anonymized data of Facebook users who visit and are active on the Replaio fan page. The legal basis for processing such data is our legitimate interest based on Article 6(1)(f) of the GDPR, which involves promoting our brand.

While using the Facebook service provided by Meta Ireland, Replaio acts as a joint data controller for data concerning users' use of the Replaio fan page. More information about this data processing method can be found at: https://www.facebook.com/legal/terms/page_controller_addendum.

4.1.9. Other Services

As part of the option to create playlists of favorite songs on Spotify available from within the Replaio Radio application, we may process data necessary to integrate Replaio with the user's Spotify account. For this purpose, we may process the user's identifier in the Spotify service. We process this data to fulfil the contract following Article 6(1)(b) of the GDPR.

5. What rights do you have?

The General Data Protection Regulation (GDPR) grants individuals-specific rights regarding their data.

The General Data Protection Regulation (GDPR) grants individuals certain rights regarding their personal data. Replaio ensures that users of its services are able to exercise these rights, subject to the technical possibilities and limitations of applicable law.

By using Replaio services, you are entitled to the following rights regarding the processing of your data:

Right to access data

You are entitled to be informed about the personal data we process, and you can request access to this data.

Right to rectification and completion of data

You can correct your data. If you become aware that your data processed by us is incorrect, outdated, or incomplete, you are entitled to request immediate rectification or completion.

Right to erasure of data

A user who has created a Replaio account can request its deletion at any time.

  2. Go to the Menu and select Account.
  3. Click the more icon (three dots) and select the Delete account option.

  2. Click "Log in" and log in to your Replaio account.
  3. Select the "Delete account" option and confirm the deletion of your Replaio account.

Right to restriction of data processing

You are entitled to temporarily or permanently cease the processing of all or some of your data.

Right to object

You can object at any time to the processing of your data by us.

Right to data portability

You are entitled to data portability – you can request a copy of your data in electronic form and the right to transfer it to another entity for use in providing services by that entity.

Right to complain with a supervisory authority

You are entitled to complain with a supervisory authority responsible for data protection.

6. How long do we store personal data?

We store personal data for as long as necessary for:

  • providing services at the highest level,
  • business interests related to the development and improvement of provided services,
  • ensuring compliance with legal obligations,
  • resolving claims and disputes.

Most data is retained only for the duration of your use of Replaio Services.

Personal data collected during the provision of Replaio Services will be deleted when it is no longer needed to achieve the purpose of storage.

User personal data will be deleted after consent for such processing and storage is withdrawn, as appropriate.

Deletion does not include data the correction, blocking, or deletion of which is contrary to statutory or contractual storage periods, as well as data necessary to establish, exercise, or change the contractual relationship between Replaio and the user.

7. Do we share data, and where can it be processed?

We do not transfer personal data outside the EU or the EEA unless necessary. However, some of our partners and service providers may be based in, or their servers may be located in another country. All operations related to such transfer of personal data are carried out following the regulations governing the processing of personal data, in particular the GDPR. We ensure that third-party recipients apply standard contractual clauses compliant with EU law.

Service providers with whom we collaborate to provide Replaio services

In order to provide Replaio services at the highest level and in accordance with the law, we may share certain data with trusted entities collaborating with us:

  • hosting service providers who provide us with certified and secure IT resources,
  • Internet and analytical service providers.

The transfer of data to service providers is carried out solely based on appropriate cooperation agreements that comply with the regulations governing the processing of personal data, particularly the GDPR.

a) DigitalOcean

DigitalOcean is a cloud infrastructure provider headquartered in New York with data centres around the world. As part of the provision of services, Replaio uses DigitalOcean hosting services — application servers and database servers. DigitalOcean processes data following the provisions of the GDPR:https://www.digitalocean.com/legal/gdpr.

Any transfer of data by DigitalOcean to a country outside the EU or EEA (EEA) that may be necessary for the provision of the services is based on data protection guarantees in accordance with the GDPR, in particular under data transfer agreements containing standard contractual clauses approved by the Commission European.

b) Cloudflare

Cloudflare, Inc. is a company dealing with internet infrastructure and security of internet services. Cloudflare stores information on servers that may be located anywhere in the world. Cloudflare is committed to providing guarantees that ensure an adequate level of data protection.

Cloudflare relies on Standard Contractual Clauses as the legal mechanism for transferring personal data from the EEA (EEA) to the US. Cloudflare Inc. processes data following the provisions of the GDPR: https://www.cloudflare.com/gdpr/introduction.

c) Freshworks

Freshworks Inc 2950 S. Delaware Street, Suite 201 San Mateo, CA 94403, USA, hereafter Freshworks

Freshworks Inc. provides, among others, the Freshdesk service https://freshdesk.com, which, as part of the provision of Replaio Services, we used to handle contacts with our users to provide technical assistance and support regarding the use of the application. As part of this purpose, the following are processed, among others: e-mail address and message content.

Freshworks processes personal data in the USA, EEA and other countries through third parties whose services it uses. Freshworks Inc. ensures a high level of security and processes data following the provisions of the GDPR: https://freshdesk.com/gdpr.

d) Bugsnag

Bugsnag Inc. 30 7th Street, San Francisco, CA 94103 USA, hereafter Bugsnag

Bugsnag provides Replaio with a secure bug monitoring service and analysis of how users use the Replaio Radio application.

Bugsnag collects and processes personal data following the requirements of the EU General Data Protection Regulation (GDPR). Bugsnag may transfer personal data outside the EEA (EEA), usually to the United States. Other Entities

Apart from the cases described above, we do not disclose or transfer personal data to other users and entities. However, based on applicable law, we may be obliged to disclose personal data in certain situations, such as to law enforcement authorities, state authorities, or other users to assert their claims. In such cases, only the data to which we are obligated to disclose will be subject to transfer.

8. Where Do We Obtain Personal Data From?

To deliver Replaio Services, we may obtain personal data from other trusted and law-abiding external partners.

8.1. Authentication Service Partners

When creating a Replaio account, you have the option to log in using your account from one of the following services: Facebook, Google, and Huawei. In this case, our partners provide us with the necessary data to set up your account. This process occurs through secure APIs provided by our partners.

Replaio may process your name, email address, and profile picture. This information is necessary to identify you when using the Replaio account.

8.1.2. Login with your Google account

In the next step, you will be redirected to the Huawei service, where you can log in using your authentication credentials. Upon successful login, Huawei will provide Replaio with basic user data stored in your Huawei profile. These are publicly available data shared with third-party services with your consent. Replaio may process your name, email address, and profile picture. This information is necessary to identify you when using the Replaio account.

8.2. Partners providing technical services

We use the services of partners who provide IP address mapping for us. This allows us to determine the approximate location of users. We determine the location only at the country level. This is necessary to provide Replaio services and ensure appropriate features and content tailored to the user.

9.How do we protect personal data?

We respect the personal data of our users and strive to provide them with the highest possible level of protection. We operate following applicable law and use reasonable administrative, logical and physical safeguards designed to protect personal data against loss, theft, unauthorized access, use, or modification. These safeguards are intended to ensure a level of security appropriate to the risks associated with the processing of our users' data. We have implemented and applied various data protection policies, including pseudonymization, data encryption, and access control, and the data is stored in certified, secure Data Centers.

10. Protecting children's privacy. Do we collect data from children?

Our services are not directed at children under the age of 13, and we do not knowingly collect information about them. If we become aware that a person under the age of 13 has provided us with their data, we will immediately delete it.

If you have information that a child under the age of 13, or a child over the age of 13 without parental consent, has provided us with personal data, please contact us. If we learn that we have collected any personal data from children that we should not process, or for which parents have not given consent, we will take immediate steps to delete such data.

11. Cookie Policy (including similar technologies)

Replaio websites and services, including repla.io, blog.repla.io, console.repla.io, and the Replaio Radio app, may use the technical capabilities provided by web beacons, such as cookies or similar technologies, including unique identifiers. In the rest of this document, we will refer to all these solutions as "cookies."

Cookies, which may be stored on a computer, smartphone, or tablet when visiting websites and internet services, are used to collect and store information about user activity. This allows user preferences to be used for displaying more relevant search results, delivering expected content, or displaying advertisements and promotional offers tailored to user interests.

Cookies typically contain the domain name of the internet service, from which they originate, a unique identifier, and the duration of their storage on the device.

For what purpose do we use cookies?

We use cookies or similar technologies on the repla.io and blog.repla.io websites in the Replaio Services for the following purposes.

  1. We provide services, including maintaining user sessions after logging in, so that users do not have to re-enter their login and password on each subpage.

  2. Optimization efforts are undertaken to ensure our services and pages operate faster and are easier to use.

  3. We conduct analyses and gather statistics to understand how users interact with our services and pages. This enables us to develop and tailor our services to meet user expectations and needs.

  4. We facilitate the presentation of advertisements to users based on their interests.

What types of cookies do we use?

  1. Necessary cookies – ensure the proper functioning of the websites and their basic functions. Without them, users would not be able to properly use the services available on the websites.

  2. Analytical cookies – our websites use cookies provided by Google Analytics. Analytical cookies enable us to track the number and source of visits so that we can measure and improve the performance of our services. This type of cookies helps us understand which pages are most or least visited and how visitors use our services. We also cooperate with external partners who provide us with analytical tools, e.g., Google Analytics. Google uses its cookies in this case.   3. Marketing cookies – our services use the capabilities of third-party cookies to target and display advertisements and promotional offers. This allows us to partially fund the development of our services by displaying banner ads, video ads and promotional offers that are well-tailored to your interests and online activity. In this case, we use the services of external advertising service providers, including Google. Consent management and legal compliance

To ensure transparency and control over the processing of personal data for our users, we use practices consistent with IAB Europe standards. It is a European association dealing, among other things, with developing standards in the field of digital marketing, advertising, and the processing of personal data. IAB has developed the TCF (The Transparency & Consent Framework) standard, which helps implement solutions in compliance with legal regulations regarding privacy and personal data processing, in particular with the GDPR.

As part of the Replaio Services, we have implemented a tool for managing consents regarding the processing of personal data, in particular for the processing of Cookies or similar technologies, hereinafter referred to as CMP (Consent Management Platform). This tool is provided by Didomi — didomi.io. And is certified by IAB Europe and Google. Didomi's privacy policy is available at: didomi.io/privacy-policy.

Users of Replaio Services, thanks to the CMP tool, can control how Replaio, our partners and other parties use the opportunities provided by cookies or similar technologies.

Most of our advertising partners are IAB Europe certified suppliers. You can see the list of all partners directly in the Replaio Radio application in the consent management window (CMP).

Our CMP tool may not be available or may look different depending on your location.

As part of the use of the CMP tool, information may be saved on the user's device, including cookies or unique identifiers used to save settings regarding consent to the processing of personal data. We process this data to provide services, i.e., perform the contract and in a legitimate interest following Art. 6 section 1 letter f GDPR.

No consent to save cookies or similar technologies

If a user does not want cookies or similar technologies to be used on their devices, they can choose an option to block their use. However, we would like to emphasize that blocking all cookies and similar technologies may negatively affect the performance, efficiency, and convenience of using our services and websites, and some features may become unavailable.

Mobile device identifiers and settings

Ustawienia w urządzeniach lub usługach, z których korzystają użytkownicy, mogą udostępniać dodatkowe opcje pozwalające na rezygnację z dopasowywania reklam i ofert promocyjnych do zainteresowań i aktywności w internecie. Na przykład w systemie Android lub usługach Google użytkownik może skorzystać z opcji „Usuń identyfikator wyświetlania reklam”. Na urządzeniach z systemem iOS dostępna jest opcja "Spersonalizowane reklamy".

Settings on devices or services that users use may provide additional options to opt out of tailored ads and promotional offers based on interests and online activity. For example, on the Android system or Google services, users can use the “Opt out of Ads Personalization” option. On iOS devices, there is an option called "Personalized ads".

12. The supervisory authority

The supervisory authority for the protection of personal data in Poland is the President of the Personal Data Protection Office with its registered office in Warsaw, ul. Stawki 2, e-mail address: kancelaria@giodo.gov.pl. You are entitled to complain to the Personal Data Protection Office in any case if you believe that your data is being processed incorrectly.

13. Changes to the Privacy Policy

This privacy policy may be modified to keep it current and reliable information about the processing of personal data.

If the changes are material, we will notify you by displaying information on the Replaio Services or by sending an email. We reserve the right to notify you in advance of changes to the privacy policy.
